1. Acceptance of Terms

By accessing or using RetireCan (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We may update these terms from time to time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

RetireCan provides retirement planning calculators and financial modelling tools, including RRSP/RRIF/TFSA withdrawal strategy modelling, financial independence calculators, Smith Manoeuvre analysis, and Cash Damming analysis. The Service is designed for Canadian residents and is based on Canadian tax rules and benefit programs.

3. User Accounts

Some features may require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when creating an account and to update your information as necessary. You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to: (a) use the Service for any unlawful purpose; (b) attempt to gain unauthorized access to the Service or its systems; (c) interfere with or disrupt the Service or its infrastructure; (d) use automated tools to scrape, crawl, or extract data from the Service without permission; (e) impersonate any person or entity; or (f) use the Service to transmit malicious code or harmful content.

5. Financial Disclaimer

The Service provides educational and illustrative tools only. Nothing on this site constitutes financial, investment, tax, or legal advice. All calculations are based on simplified models, assumptions, and publicly available data that may not reflect your actual situation or the most current tax rules. Tax brackets, benefit thresholds, and other constants are estimates and may differ from actual CRA assessments. You should always consult a qualified financial advisor, tax professional, or legal counsel before making financial decisions.

6. Intellectual Property

All content, features, and functionality of the Service — including text, graphics, logos, icons, software, and design — are the property of RetireCan or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Service without our prior written consent.

7. User Content

Any data you input into the calculators (such as account balances, income figures, or ages) is processed to generate your results. We do not claim ownership of your input data. By using the Service, you grant us a limited right to process your data solely for the purpose of providing the Service to you.

8. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in our Privacy Policy. Calculator inputs may be stored locally in your browser for convenience and are not transmitted to our servers unless you explicitly save or share your results.

9. Subscriptions and Payments

Certain features of the Service may require a paid subscription. By subscribing, you agree to pay the applicable fees. Subscriptions renew automatically unless cancelled before the renewal date. Refunds are handled in accordance with our refund policy. We reserve the right to change pricing with reasonable notice. All prices are listed in Canadian dollars unless otherwise stated.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately, though provisions that by their nature should survive termination will remain in effect.

11. Limitation of Liability

To the maximum extent permitted by law, RetireCan and its operators, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless RetireCan and its operators from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Material changes may be communicated via email or a notice on the Service. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
